Travel Money Concierge Services Terms & Conditions

These Terms & Conditions (the "Terms") govern the use of the concierge services provided by TRAVEL MONEY SAS, a simplified joint-stock company (société par actions simplifiée) incorporated under French law, with registered office at 14 rue Charles V, 75004 Paris, France, registered with the Paris Trade and Companies Register (the "Company" or "Travel Money" or "TM").
By using any Travel Money platform or service, including mobile applications, website, browser extensions, or any related software, product or service (together, the "Platform"), you (the "Customer" or "Principal") acknowledge that you have read, understood, and accepted these Terms.
1. Purpose and Scope
Travel Money operates as a concierge and agent service (the "Travel Money Concierge" or "TMC") providing two distinct activities:
(a) Purchasing Agent Services: Acting as your authorized representative, shopping agent, and purchasing agent to acquire goods on your behalf from retailers, merchants, and brands with delivery arranged to your specified address outside the European Union. This can include export services, including managing export and import fees, taxes, tariffs and shipping the items to the Customer.
(b) VAT Refund Management Services: Managing VAT refund procedures for eligible travelers making purchases during temporary stays in France, carried out in accordance with the French Tax Code and customs regulations applicable to approved tax refund operators.
IMPORTANT:
Travel Money acts exclusively as your agent and authorized representative. All purchases made through the TMC are made on your behalf as your authorized purchasing agent.
2. Definitions
For the purposes of these Terms:
"Goods" means physical, non-consumable goods that you authorize Travel Money to purchase on your behalf from retailers and merchants, with a view to export and delivery outside the European Union. These goods must follow all applicable laws and fall under typical, exportable conditions.
"Agent Services" or "Concierge Services" means the services provided by Travel Money acting as your authorized representative and purchasing agent to acquire Goods on your behalf.
"Purchase Authorization" or "Agency Agreement" means the authorization and agency relationship granted by you to Travel Money, empowering Travel Money to act as your authorized representative to identify, negotiate, and complete purchases on your behalf.
"Service Fee" or "Concierge Fee" or "Commission" means the fee charged by Travel Money for providing Agent Services, including research, sourcing, purchase facilitation, logistics coordination, and export management.
"Export Delivery" means the shipment and delivery of Goods purchased on your behalf to your designated address outside the European Union, qualifying as an export exempt from French VAT pursuant to Article 262-I of the French Tax Code.
3. Customer Eligibility
The Travel Money Concierge services are strictly reserved for customers:
- established and residing outside the European Union;
- acting as final consumers purchasing for personal use; and
- requesting delivery of Goods outside the European Union.
Travel Money may request any information or documentation necessary to verify Customer eligibility and compliance with applicable regulations.
4. Legal Nature of the Concierge Service
When you engage Travel Money Concierge services, the following legal relationship is established:
(a) Agency Relationship: You appoint Travel Money as your authorized representative, shopping agent, and purchasing agent with authority to act on your behalf;
(b) Ownership Transfer to Travel Money: All Goods are purchased directly for you as the beneficial owner;
(c) Direct Purchase in Your Name: Where practicable and permitted by the merchant, purchases are made directly in your name. Where merchants require invoicing in the name of Travel Money for operational or tax purposes, such invoicing is done pursuant to your authorization and Travel Money holds such rights on your behalf as your agent;
(d) Logistics Coordination: Travel Money arranges for the physical export and delivery of the Goods to your designated address outside the European Union;
(e) Service Fee Structure: Travel Money charges a Service Fee for providing concierge and agent services, which is separate from and in addition to the purchase price of the Goods.
IMPORTANT:
Travel Money does NOT act as a marketplace, retailer, commission agent, or payment service provider. Travel Money operates exclusively as your authorized purchasing agent and concierge service provider.
5. How the Concierge Service Works
5.1 Service Request and Authorization
You submit a request through the Platform specifying the Goods you wish to purchase. By submitting this request, you grant Travel Money a Purchase Authorization (the "Purchase Authorization Consent Agreement" or "Purchase Authorization") to act as your shopping agent and authorized representative to:
- Identify and source the requested Goods from retailers and merchants;
- Negotiate on your behalf where applicable;
- Complete the purchase transaction on your behalf;
- Arrange for export documentation and delivery to your specified address.
IMPORTANT:
Travel Money is acting as your shopping agent and authorized purchasing representative. Travel Money is not a marketplace reseller.
5.2 Purchase Process
Travel Money, acting as your agent, will acquire the Goods through one of the following modalities:
Modality A - Direct Purchase by Customer Facilitated by Travel Money: Where the merchant permits, Travel Money facilitates a purchase on your behalf, with the payment to the merchant made by the Customer and the purchase invoice ("Bill To") made out to Travel Money SAS at 14 Rue Charles V 75004 Paris. Travel Money coordinates payment and logistics on your behalf.
Modality B - Direct Purchase by Travel Money on behalf of Customer: Where the merchants permit, the Customer selects the Goods they wish to purchase as part of the Customer's Purchase Authorization Consent Agreement, then Travel Money purchases the item on behalf of the Customer, then the purchase invoice is issued in the name of Travel Money SAS pursuant to your Purchase Authorization. In this case:
- (i) Travel Money holds the invoice and any associated rights on your behalf as your agent, and transfers the good to the Customer with a corresponding invoice for the product price less any applicable VAT plus any applicable taxes and fees;
- (ii) You are the final beneficial purchaser and owner of the Goods after transfer;
- (iii) Any VAT charged on the purchase may be exempt through export procedures;
- (iv) Travel Money does not acquire ownership for resale purposes as it is acting on your behalf as part of the Purchase Authorization consent agreement.
In both modalities, Travel Money is acting as an authorized representative with purchasing authority on behalf of the Customer pursuant to the Purchase Authorization Consent Agreement that the Customer automatically accepts by using any of Travel Money's Services or registering an account with any of Travel Money's Services.
5.3 Payment Structure
You will be invoiced by Travel Money for:
- (a) Product Purchase Price: The price of the Goods paid to the merchant (less any applicable VAT);
- (b) Service Fee/Concierge Fee: Travel Money's fee for providing agent and concierge services;
- (c) Shipping and Logistics Costs: Export shipping, handling, and delivery charges;
- (d) Insurance Costs: If elected;
- (e) Foreign Customs Duties and Taxes: Any import duties, taxes, or fees applicable in your destination country (where paid on your behalf).
5.4 VAT Treatment and Export Exemption
VAT Deduction: Where the purchase invoice is issued in the name of Travel Money, any VAT charged by French merchants is potentially deductible by Travel Money pursuant to Article 271 of the French Tax Code, subject to applicable conditions.
Export Exemption: The delivery of Goods to you outside the European Union constitutes an export exempt from French VAT pursuant to Article 262-I of the French Tax Code. The benefit of this exemption is reflected in the pricing structure.
TMC Does Not Offer Direct VAT Refund to Customer: You expressly acknowledge that Travel Money Concierge does not provide a direct VAT refund to you as such. Any VAT-related savings result from the export exemption mechanism and are incorporated into the Service Fee structure in accordance with applicable law and these Terms.
6. Export Logistics and Proof of Export
Travel Money coordinates the transport and export formalities of the Goods through professional express freight companies.
Travel Money retains the electronic export declaration and customs documentation provided by the professional express freight companies submitted, which serves as the proof of export for VAT purposes.
7. VAT Refund Management for Travelers
Where expressly offered, Travel Money may also provide a VAT refund management service for eligible travelers making purchases during temporary stays in France.
This service operates pursuant to Travel Money's approval as a tax-free operator under Article 262-0 bis of the French General Tax Code and Articles 202 E to 202 O of Appendix II thereto, and is subject to the terms and procedures referenced there.
8. Customer Obligations
You undertake to:
- (a) Provide accurate and complete information regarding your eligibility, orders and delivery details;
- (b) Acknowledge your consent and authorization to make Travel Money and its representatives your authorized purchasing agent;
- (c) Comply with all payment obligations in a timely manner;
- (d) Ensure that your use of the services complies with all applicable tax, customs, and import and export regulations in your jurisdiction;
- (e) Refrain from any use of the services that would violate these Terms or applicable laws.
9. Brand Policies and Restrictions
Compliance with Brand Policies: Many luxury brands and retailers maintain policies restricting resale of their products. Because Travel Money acts exclusively as your authorized purchasing agent and does not acquire goods for resale, the services provided through the TMC are structured to comply with such policies.
Customer Responsibility: You acknowledge that you are the beneficial purchaser of all Goods and that you are purchasing for personal use and not for commercial resale.
Restrictions: Travel Money reserves the right to decline service requests that may violate brand policies, trademark rights, applicable laws, or for any other reason. You may request a formal reasoning for declined service requests by contacting support@travelmoney.app.
10. Liability
Travel Money's liability is limited to direct damages proven to result from a breach of these Terms, subject to applicable mandatory law.
As an agent acting on your behalf, Travel Money shall not be liable for:
- (a) The quality, authenticity, merchantability, or fitness for purpose of Goods purchased from third-party merchants or for Goods shipped by third-party logistics providers;
- (b) Acts or omissions of third-party merchants, manufacturers, or logistics providers beyond Travel Money's reasonable control;
- (c) Customs delays, duties, or import restrictions imposed by your destination country or shipping country;
- (d) Changes in merchant availability, pricing, or policies;
Travel Money will use commercially reasonable efforts to assist you in resolving any issues with purchased Goods, including facilitating warranty claims or returns in accordance with merchant policies.
11. Cancellation and Returns
Pre-Purchase Cancellation: You may cancel a service request before Travel Money has completed the purchase on your behalf. Cancellation fees may apply if Travel Money has already incurred costs.
Post-Purchase Returns: Once Goods have been purchased on your behalf, returns are only allowed for damaged or defective goods.
12. Intellectual Property
All intellectual property rights in the Platform, including trademarks, logos, and content, belong to Travel Money or its licensors.
You may not use Travel Money's intellectual property without prior written consent. All brand names, trademarks, and product names referenced in connection with the services remain the property of their respective owners.
13. Data Protection and Privacy
Travel Money processes your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for detailed information on data collection, use, and your rights.
14. Governing Law and Jurisdiction
These Terms are governed by French law.
Any dispute relating to their validity, interpretation, or performance shall fall within the exclusive jurisdiction of the competent courts of Paris, subject to mandatory consumer protection rules applicable to consumers domiciled in the European Union.
15. Amendments
Travel Money may update these Terms from time to time. The version in force is the one published on the Platform at the time of use. Continued use of the services after any amendment constitutes acceptance of the modified Terms.
16. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with any additional terms referenced herein (including the Privacy Policy and any specific service terms), constitute the entire agreement between you and Travel Money concerning the use of the services.
